We created this Privacy Policy to provide you with important information about the privacy practices applicable to the services provided by us through the Beautywerx website and telehealth platform (collectively, the “Site”) through which the services (“Services”) are provided. This Privacy Policy describes how we collect, protect, use, disclose, and store the information collected through the Services.

What is Personal Information?

Beautywerx collects Personal Information from users when such users register for and use the Services. You do not have to use the Services, but if you do, you acknowledge that Beautywerx collects and uses your Personal Information for the legitimate interests and purposes described in this Privacy Policy. Beautywerx collects the following types of Personal Information which you provide to us:

• Registration information related to Users;
• Health information about Users provided by the users, and/or the telehealth providers through use of the Services;
• Records and copies of your correspondence (including email addresses), if you contact us;
• Contact details you may provide, such as your name and email address; and
• Details of transactions you carry out through our Services, including payment information.

In addition, from time to time, we may use or augment the Personal Information we have about you with information obtained from other sources, such as public databases, social media platforms, and other third parties.

In addition to collecting Personal Information that you provide to us, we may automatically collect certain Personal Information when you use the Site, such as IP address, information about your browser, device, or operating system or similar information. IP addresses are ID numbers for the location of your computer or network on the internet. Log files are recordings of the traffic to and from a server. Beautywerx servers log IP addresses for systems administration and troubleshooting. We track page hits in the aggregate to track the popularity of pages that people visit. With that information we can improve the quality of our Site. We may also use or allow third parties to use web beacons on our Site to monitor the effectiveness of survey qualification. Web beacons are small, graphic images on web pages, web-based documents, or in email messages that allow us or third parties to monitor who is visiting our Services or if an email has been read. Web beacons collect the IP address of the device where the web beacon is sent, the URL of the page where the web beacon originates, and the time it was viewed. Web beacons may be linked to your Personal Information. We may also use third party devices, services, links, or electronic mail to deliver surveys to you, which may use cookies, web beacons, or other technology to collect information about your visits to our Site (or other websites) in order to present surveys that may be of interest to you.

• personalize your experience on the Site by presenting products and offers tailored to you;
• further our business purposes, such as quality assessment, data analysis, audits, developing new products, enhancing the Services, identifying usage trends to inform members of the Beautywerx community which aspects of the Services might be useful to them, and determining the effectiveness of our promotional campaigns; and

Beautywerx does not, to the best of our knowledge, sell or rent Personal Information that we have collected or retained about you to any other third party for any purpose.

We may also disclose to third parties aggregate or de-identified data that is not personally identifiable for any legally permissible purposes.

COOKIES

A cookie is a small piece of information that a website can store on a computer and sometimes later use to recognize a user. The purpose of cookies is to enhance your ability to receive the information you want. In the future, we may use cookies to enhance the experience of users. A “session” cookie expires when the user closes the browser in which the website was viewed. A “persistent” cookie may be used to help save your settings and customizations. As with all cookies, you can personalize you web browser settings to reject session cookies. Though some cookies, that are strictly necessary for site operation, cannot be toggled off.

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including our health care provider partners, the manufacturer of your mobile device, and any other third party mobile application or website to which the Site may contain a link.

HIPAA

Beautywerx is not a health care provider or any other type of Covered Entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). However, to the extent Beautywerx ever acts as a “Business Associate” under HIPAA, Beautywerx shall comply with the requirements of HIPAA.

SECURITY

We seek to use reasonable physical, technical and administrative measures to protect Personal Information under our control. Unfortunately, no data transmission over the Internet or data storage system is completely secure; therefore, we cannot guarantee against all potential security breaches. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below.

STORAGE OF DATA
